We are an enrollment services platform that connects community college students and 4-year universities to boost transfer success.

This Terms of Service applies to your use of the edvisorly.com website and the EdVisorly Service (collectively “the EdVisorly Service'' or “the Service”), as well as your relationship with EdVisorly, Inc. (“EdVisorly”).

If you do not agree with these Terms, including the Binding Arbitration Clause and a Class Action waiver included below, please discontinue using the Service.

These Terms will change over time. If we make minor changes to the Terms without materially changing your rights, we will post the modified Terms on our website. We will notify you by email, through the EdVisorly Service, or by presenting you with a new Terms of Service to accept if we make a modification that materially changes your rights. When you use the EdVisorly Service after a modification is posted, you are notifying us that you accept the modified terms.

If you have a written agreement with EdVisorly that states that it supersedes this Terms of Service (for example if you are a Community College, University, or Partner), then to the extent there is any conflict between the documents, the provisions in your separate agreement apply.

EdVisorly takes user privacy seriously and does not permit third parties to bulk collect student data, university data, community college data, or other marketplace information from our Services through the use of automated scripts (“scraping”), similar or other technologies or methodologies.

Account Creation

You need to have an account to use EdVisorly. You can create an account on EdVisorly as a currently enrolled student seeking transfer advice or to transfer to a 4 year university, as a university looking for exciting new talent, or as an education planning professional. You agree not to misrepresent any information about yourself in creating or using an account.

EdVisorly Partners retain access to student data shared in student accounts as part of their administrative duties. Students will be informed whether universities have explicit partnerships with EdVisorly.

By creating an account on EdVisorly, you consent to receive calls, texts, emails, and advertising ("Communication") from EdVisorly Partners using the contact information provided, including mobile numbers and email addresses, which may be sent with automated or pre-recorded technology. You may opt out of EdVisorly Partners' Communication at any time. 

Creating a Student Account Associated With Your Community College:

 You may create your Student Account because you are a student at an EdVisorly Partner Community College (“Community College Partner”). Community College Partners use EdVisorly as a service provider to manage their internal and external university transfer functions, such as supporting students in university exploration, connecting aspiring transfer students with transfer friendly universities, providing reports to community colleges to improve course availability for students, mapping courses for existing and future transfer pathways, and passing transcripts to interested universities. When Community College Partners sign up for EdVisorly, they may send us personal information about their students so that EdVisorly can provide these services.

Your Community College will send you an email with information about how to enable your Student Account. After you do so, and we confirm your association with our Community College Partner, we pre-populate some areas of your profile with information your Community College has provided. We encourage you to review this information for accuracy and completeness. Some of this information may be locked by your Community College and you cannot edit it using EdVisorly. If any inaccuracies are found, please update the information or contact your Community College accordingly. Should you have trouble contacting your Community College, please contact EdVisorly Support at hello@edvisorly.com

Creating a Student Account Not Associated With a Community College Partner:

Currently enrolled community college students may create an account on EdVisorly if your school is not a Community College Partner by using your email address, phone number, or social media login. 

You have the option to provide additional information when creating your student account, such as a profile picture, self identifiers, and to upload documents, such as your transcript. Any information or content you upload directly to the EdVisorly Service is governed by these Terms.

Creating a University Account:

To create a University Account you must either associate yourself with a current EdVisorly University Partner (“University Partner”) and be approved by that university or create a new University Account. University Partners do not have access to any student profiles unless they are approved by EdVisorly, or the student’s Community College, to access student information that the student chooses to share.

You agree that any information you provide through account registration is accurate, current, and complete, and you agree to update your information as necessary to maintain its truth and accuracy. Also, please note you are prohibited from creating an account for anyone other than yourself and your University unless you have received express authorization from another EdVisorly Partner University to do so on their behalf.

To create a student account, you must be at least 16 years old to use this Service. If you are not 16 years of age, please have a parent or legal guardian fill out this form and submit it to hello@edvisorly.com to use the Service.

Student Account Guidelines

Your EdVisorly profile is your first impression for transfer friendly universities around the country. As a rule of thumb, keep your content and communications on EdVisorly professional. Specifically, you are not allowed to post any violent, nude, discriminatory, hateful, or sexually suggestive photos or other similar content via the Service. You are responsible for all content you upload to EdVisorly.

EdVisorly allows you to view profiles and send messages to other students and universities through the Service, including students at other community colleges or institutions. You agree not to stalk, defame, bully, harass, abuse, threaten, intimidate, or impersonate other people or entities. You also agree not to use the Service for any illegal or unauthorized purpose, including spam, copyright infringement, identity theft, or fraud.

You agree you will not attempt to restrict another user from using or enjoying the Service and you must not encourage or facilitate violations of these Terms of Service or any other EdVisorly terms.

Recording of EdVisorly Communications

Wiretapping laws in some U.S. states prohibit recording individuals without their awareness and consent. You may not initiate an audio or video recording of any third party in violation of the law. By initiating any audio or video recording through the Service, you represent and warrant that you have express permission from all persons appearing in the audio or video recording for all potential uses by EdVisorly of such audio or video recording where required by law. You agree that you will not hold us responsible and we will not be liable for your failure to inform others that you are recording them and/or your failure to obtain their prior consent.

Continuing Support

EdVisorly is committed to helping you succeed in the exploring, connecting, and transferring to your dream university. We encourage you to update your contact information with a personal email address or social media login, so you won’t lose access to your profile once your student email address expires, and to keep your profile current. Any information you share directly with EdVisorly is subject to these Terms and our Privacy Policy.

Creating a University Account

When you create an EdVisorly University Account, we request contact information, including email address and telephone number, to provide a secondary point of contact for the EdVisorly support team. This contact information will not be made available on your public profile. You have the option to set your profile as “public” or “private” during account creation, and may change your account visibility at any time by opening User Settings from the Account Dashboard. We will not use your phone number to send any commercial or marketing messages to you from third parties. You agree to provide accurate and current information and to correct any misrepresentations immediately upon discovery.

Once your account has been approved by EdVisorly, you may receive student data through our Service. You are prohibited from disclosing or sharing this information with other parties, and agree to keep student data confidential. You shall only use student data to provide University transfer and admissions services to the student and not use, sell, or disclose EdVisorly Data for any purposes including data analytics, data monetization, advertising, marketing or any other purpose even if such EdVisorly Data is aggregated or de-identified. You agree to handle and maintain collected student data with equivalent or superior standards as those described in our Privacy Policy, including the requirements of the General Data Protection Regulation (GDPR) (EU) 2016/679 regarding any Student Personal Data you receive from EdVisorly.

You also agree not to use the Service to send spam or other unauthorized communications, and you agree not to use any collected student data for purposes not authorized by EdVisorly. These prohibitions are addressed in further detail below.

University Account Guidelines

Through the use of the Service, you will be able to search and filter student results based on a wide range of criteria. You agree to maintain a fair and equitable admissions process when engaging and selecting student candidates. You also agree not to discriminate based on ethnicity, national origin, religion, age, gender, sexual orientation, disability, or veteran status as prohibited by law. You have the ability to contact students directly through the Service. By using this Service, you agree not to stalk, defame, bully, harass, abuse, threaten, intimidate, or impersonate any people or entities.

University Accounts are administered by designated Account Administrators. If the University chooses to allow additional individual employees to access the University Service through the University Account, you agree that the account administrators are responsible for the use of the Service by those individual employees, including requests related to personal data collected from those individual employees. You acknowledge and agree that EdVisorly is not responsible for the privacy or security practices of an administrator's organization, which may be different from these Terms or our Privacy Policy.

You acknowledge and agree, moreover, that, to ensure your compliance with these Terms, EdVisorly may review the University Discover Page associated with any new content or post before it becomes available to applicants on the EdVisorly Service. In addition, EdVisorly reserves the right to review messages shared between the student and the University on as needed basis.

No Spam

We want EdVisorly to be a platform where Universities can connect with students and other users in a way that is productive for all involved. To that end, while we allow Universities to contact students and other users, we do not allow you to use the Service to send unsolicited marketing messages or broadcasts (i.e., spam).

Spam can take many forms, and our rules are meant to address a wide range of inappropriate content or messaging, including:

  • Unsolicited messages that aim to drive traffic or attention from the EdVisorly Service to accounts, websites, products, services, or initiatives not directly related to a transfer guidance and support communicated on the platform;
  • Bulk or repeated identical messages, or high-volume messages with a low student response rate;
  • Messages that fail to comply with applicable anti-spam laws and regulations.

If we determine that you have sent spam or other unauthorized content, we may take any action we deem necessary to protect our users’ experience or the Service, including demanding that you cease violating these Terms, suspending your student messaging privileges, or suspending or terminating your account(s).

Creating an Education Planning Professional Account

EdVisorly Partner Community Colleges retain access to student data as part of their administrative duties. For EdVisorly partner Community Colleges, employees may be able to view any student profile associated with their Community College.

We designed EdVisorly with a student first approach and we do our best to protect against possible misuse of the Service. Students will be informed whether their community college has an explicit partnership with EdVisorly. Education Planning Professional Accounts are accessible for EdVisorly partner Community Colleges and third party partners that support Community College enrollment for the purpose of transfer to an EdVisorly partner University. Education Planning Professionals are prohibited, under any circumstance, from sending messages on behalf of the Student using their profile. Only Education Planning Professionals with an active partnership with EdVisorly are permitted to create an account and must be approved by an EdVisorly Account Manager. Community College faculty, staff, administrators, and employees without an active partnership with EdVisorly are prohibited from using EdVisorly in any form to support internal student services operations and are encouraged to contact us directly at hello@edvisorly.com or on our website, to onboard your respective community college.

External Data

EdVisorly may utilize de-identified and disaggregated data for research and analysis purposes to enhance our services, improve educational outcomes, and contribute to the field of education. All data used for research purposes is de-identified and does not contain personally identifiable information.

EdVisorly is a licensee of  Peterson's Data ("Peterson's") with the sole purpose of populating university data into the EdVisorly platform.

Neither party makes any representations or warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose.  Both EdVisorly and Peterson's do not warrant that the work will be error free, nor do they guarantee any results from its use. EdVisorly and Peterson's will not be liable for inaccuracies, errors, omissions, delays, damages, claims, liabilities or losses, regardless of cause, in or arising from the use of the work. The data provided in the work is provided to EdVisorly "as is" and without warranty of any kind.

EdVisorly Chat

General Behavior:

Our chat is expected to be a friendly and welcoming place where members can post without their motives, intelligence, or other personal characteristics being questioned. Members who make others feel unwelcome or uncomfortable, or who conduct themselves in a manner detrimental to the EdVisorly community, may lose posting privileges.

Discussion, not Debate:

EdVisorly’s chats exist to discuss college admission and other topics of interest. It is not a place for contentious debate. If you find yourself repeating talking points, it might be time to step away and do something else. Some topics, such as politics, religion and moderation on the chats, lend themselves to debate. If a thread starts to get heated, it might be closed or heavily moderated.

General Behavior Commercial Posts, Repetitive Posts, Spam:

We recognize that occasionally a post may contain a URL which could be of value to our members. However, if a user repeatedly promotes an external product or service, the community may identify their posts as spam. Spam posts will be flagged and removed. If you are interested in promoting your business, book or service, please contact us about advertising or partnership opportunities.

Copyright:

Fair use allows brief excerpts from copyrighted material for the purposes of review and commentary. Please do not post entire articles or only quote outside sources without your own contribution. Also, be sure to provide attribution when you quote or paraphrase other people’s work.

Dont's

Users may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through EdVisorly. Use of EdVisorly data without permission is prohibited.

You agree that you will not:

  • Develop, support or use software, devices, scripts, robots or any other means or processes (including crawlers, browser plugins and add-ons or any other technology) to scrape the Services or otherwise copy profiles and other data from the Services;
  • Override any security feature or bypass or circumvent any access controls or use limits of the Service;
  • Copy, use, disclose or distribute any information obtained from the Services, whether directly or through third parties (such as search engines), without the consent of EdVisorly;
  • Disclose information that you do not have consent to disclose;
  • Violate the intellectual property rights of others, including copyrights, patents, trademarks, trade secrets or other proprietary rights. For example, do not copy or distribute content without permission;
  • Violate the intellectual property or other rights of EdVisorly, including, without limitation, (i) copying or distributing videos or other materials or (ii) copying or distributing our technology, unless it is released under open source licenses; (iii) using the word “EdVisorly” or our logos in any business name, email, or URL without permission;
  • Post anything that contains software viruses, worms, or any other harmful code;
  • Reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or any related technology that is not open source;
  • Imply or state that you are affiliated with or endorsed by EdVisorly without our express consent;
  • Rent, lease, loan, trade, sell/re-sell or otherwise monetize the Services or related data or access to the same, without EdVisorly’s consent;
  • Deep-link to our Services for any purpose other than to promote your profile on our Services, without EdVisorly’s consent;
  • Use bots or other automated methods to access the Services, add or download contacts, send or redirect messages;
  • Monitor the Services’ availability, performance or functionality for any competitive purpose;
  • Engage in “framing,” “mirroring,” or otherwise simulating the appearance or function of the Services;
  • Overlay or otherwise modify the Services or their appearance (such as by inserting elements into the Services or removing, covering, or obscuring content, information, and data included on the Services);
  • Interfere with the operation of, or place an unreasonable load on, the Services (e.g., spam, denial of service attack, viruses, gaming algorithms).
